Ripped Off and Need Help Please Hi, I am feeling really bad here, I bought a laptop, trader got disabled after payment etc went through, but he remained in touch via email (thankfully), long story short, laptop was delivered after 6 weeks, not the model I bought, overseas plug, won't charge the battery, and trader is no longer responding to emails, can I track him down through his email address and if so how, please be gentle with me I am feeling really low over the whole episode

I dont think you got mutch luck but you do know you can just fit a newzealand plug chop off the wrong plug and fit a nz plug solong as the charger is 240volt compatible.

ISP or webmail address sounds like you may need to lay a complaint with the Police,.. hope you have a good supply of 'regain',..

If you make it a police matter then trademe will be able to give his details to the police until you have his physical address I was told you can't take them to small claims

Thanks I keep alternating between feeling soooo stupid to sooo angry. This guy knows what he is doing, he even got angry with me when I questioned why it was taking so long for the so called updates that I paid for to be done, and told me he was doing me a favour. Anyway the laptop arrived today and it is not the correct one, there are no updates done to it, there is no warranty which was promised as was a tax invoice, would be nice to track him down

Put it this way you at least got the goods, sometimes you dont even get anything, the cops wont be interested , they are interested to give you a fine when they see you dont wear a seatbelt or you drive to fast...

The police may be reluctant but be firm you want to file a complaint, take as much info on the auction and emails, printed out!, once a report is filed they have to act,...

And i would be carfull with going to the cops who knows the laptop you got now may well be stolen and if the cops get there hands on they take it from you and sell it for there profit after at the police auctions So forget the help from the pigs.

Intrade you are so correct. I spoke to the Police and they were not overly interested, they told me to contact trademe which I have done, they told me to go to the disputes tribunal, but need his address etc for that. the goods he sent I am grateful for even if it is the wrong one, and not what I wanted in the first place, it could have been worse, but is there anyway I can track him down through his bank details or email address

Make due with what you got and dont ever buy a used laptop of here no more especialy when a new one is only 600$ from dicks-smiss

Yup bank details would be the only way to find him, unless he is a fraudsters then his bank account will no longer exist now.

I have kept all correspondence, emails, the auction etc, all printed out and in a file, so have all the necessary information. It shows I asked questions, and it shows his answers along with the charges for the upgrades, along with the reasons for the delays, and him telling me that I would get a tax invoice and the warranty, but alas it is not the right laptop, no warranty,

Police cant ignore a complaint basically its fraud as a first step ask the advice of trademe and keep following it through with the policwe with as much infotrmation you can give them

It wasn't a used laptop what I thought I had bought was a brand new one, with upgrades paid for and going to be done, and warranty. I at least got a laptop, which is more than what some get, but I sent an email to him telling him it was the wrong one, and asked for his address to send it back to him, and he now refuses to correspond

If you have emails, bank acc # sometimes even looking in the header on the email can reveal info. I have tracked someone down just by bank acc details and email information.

K, he's relying on you being son grateful for getting something, and that you won't bother to chase him up or get the police involved,.. so if you don't do something he'll be doing it to someone else, and so it goes on,..

I don't know how I tried looking at the header in the emails, but I don't understand any of it, and the bank account he used he said was his partners, and it is a Bnz Rotorua account and he is from Christchurch. I even tried to get an address from the courier as to where it was picked up from and all I got was it was sent from a Post shop in Riccarton

RE#21 aperantly trademe disabled the trader so there wont be no history about him left...

The seller is now disabled when I discovered this and asked him aobut it, he said it was because trademe disabled him when he tried to get a business account so he went to ebay, but don't know his user name there

Wow progress (maybe) Thank you all for your advice and comments. I read all you said and thought some more, and decided on one more email to this trader. I told him that as he was determined to not let me know how to get hold of him, I felt he was going to treat others as he had treated me, so I was going to lay a fraud charge with the Police, was going to go to the Fair Trading Commission and go to the Disputes Tribunal. After not hearing from him I got an email saying ok he would reimburse me and I could send it back, will keep you informed...fingers crossed

.... Pft he may be giving you a refund(if hes telling the truth) ofcourse dont send the laptop first. I would ask for Full refund including shipping which he charged, along with the cost of you shipping it to him. Least he could do for the time he has wasted. Also obviously the guy needs to learn a lesson not to screw other over. If i were you i'd install some virus on the machine, as revenge, But thats just me.

Get a refund and tell him he can come and pick up the laptop anytime. If he doesn't within 2-3 months you can legally keep it!

If you did need to take this guy to court provided you could get his address etc, you can actually lodge a claim with the Disputes Tribunal if he is a 'professional trader' which is what it sounds like he is. Anyone who sells more than 6 (or 8?) of the same or similar item is considered a 'professional trader'. That is maybe the only exception to the rule for taking online traders to court.

I am glad I am not the only one who had some of those thoughts, like IF I get the refund, making him wait for the return of the laptop lol, but I will be surprised if the refund even goes through. His last email was not very pleasant, but in amongst his tirade he did ask for my bank account details, so I will keep hoping, and when and if the money shows I will decide on what to do. Funny how he was not keen on emailing me before but now he is keen on sending messages which are not overly pleasant

Oh... and I really liked the idea of telling him to come pick it up haha as he is South Island and I am North Island. My husband would love to meet him lol, ( so would I to put a face to the probably false name )

Ohhh no I hope you do get your money back if you can like someone said I would put viruses galore on it lol.. or just refuse to send it back to him

Also when he makes payment wait for a week or two with the money in your account to see if it gets taken back out, he could put a cheque in and it could be fake. Make sure the funds clear. Also ring up your bank and put a password on your account incase he tries to ring up and pretend its you. Once you have the money goto the cop shop and ask if it has been stolen (i.e. if any one has reported it stolen) if it is leave it with the cops. If not then tell him you will drop it off to him in Rotorua the same place as the bank LOL.

I also hope that he has not done this before as it going to account in Rotorua and him being in the south island sounds a little bit "argh" wonder if its one of those "pay someone else" they keep a small % and forward the rest of the money to the scammer

(no subject) Spam the trade-me forums with his details and this threads link with another account after this feud is sorted out.. lol. Or give out his email address out on forums over the web so he will be absolutely FLOODED with spam!

Mrtoken I never thought of that about him having someone else take his payments and them keep some. I hope that is not happening. I have not heard anything else from him, so still have no idea if he is going to do the refund or not. I will go to the court on Tuesday to get the form done for trademe to release his details, which is a start.
