Selling Free Software ??

Selling Free Software ?? Auction 181302357 The guy seems to be selling scorched 3D, a free tank game, in a 'sealed' case. The name almost matches and the quote is a direct match to the Scorched site Is this legal ? Back in the old days shareware and recouping the cost of the media was allowed, but this seems to be a representation of free software as 'pay for use' software Any ideas ?

That's a hard one Is under the GPL? (Gnu Public License?)

Sure does sound like S3D Which is GPL and all derivitives are GPL. Which means the seller can charge for the cost of the disc and shipping. But the seller cannot charge for the game itself. The seller also has to provide the source code on demand.

I've asked on teh auctionIs this software licensed under the GPL? Will you include the source code with the game?

Perhaps he has modded it- Based on the Scorched 3D software programme - All from the thriving Open Source Community, this game keeps changing I guess it's a bit more obvious if one reads the details, and the GPL doesn't forbid - one just has to provide the source

Quite legal You can sell GPL software for any price at all, from $0 upwards. There's nothing remotely illegal or even immoral about this, and the Free Software Foundation explains why here; http://www.gnu.org/philosophy/selling.html

Thats what i want to know bouit casey-a all he sell is freeware Audacity being one of them, its a 3mb download yet it says dvd in his auction LOL

Maybe I should list a DVD software bundle. Put together OpenOffice, Firefox, Thunderbird, GIMP, Inkscape, VLC, Celestia, Blender, Audacity, Miro and Avidemux.

Heck, I'll make LiveDVD linux distro and call it a software bundle with bult in security suite for safe browsing :)How much would you pay for all this? $500?

Just as long as it's 'Sealed' :-) And you could include a professionally made case cand cover too .. Just be sure to use Creative Commons images !

Why not? One thing to be aware of; trade me have a policy against selling anything on writeable media, even if the sale is 100% legal.

Thats what i dont get, last week i got TM to pull bout 6 of his auctions for frostwire and audacity , but i guess it really is legal my bad, just dont think its ethical tho.

GPL and GNU software can be sold for whatever price anyone wants to sell them for. Just because they are opensourced doesnt mean you have to give them away for free. You can sell open office for 50 bucks a pop if you want as long as you have a cd printed for it.

There probably is a geniune market for selling things downloaded (with GPL) and put on a CD (and sold for cost + a few $s to make it worth it), since not everyone has broadband. But I can see why TM has a blanket rule against it, too much of a mine-field when actual copied software enters the mix.

The dude has every right to sell it..but posted this "Hi, this is the the latest retailed packaged version not just some cheap download from the net" ..Bullshit artist.

Plenty of market our kids make pocket money by burning Ubuntu CDs and selling them for $5. Lots of people are still on dialup and are happy to pay even thought they know it can be downloaded for free.

If you think he's selling it for too much (and I point the word "selling" as in that people are actually buying the stuff) then you can undercut him yourself. Free market forces will drop the price to what the market considers reasonable.

Got a response on the auction yes this is licensed under the gpl, source code is available on request as per the details of the gpl license

Been there done that HAD the chat with TM admin Regardless of it being paid or free software, IF YOU have burnt it on to cdr/dvdr YOURSELF, as opposed to getting a cd/dvd recording/manufacturing company to do it, then it's NOT allowed to be sold on TM. . . . dunedin_ree at is correct. The legal minefield of cdr/dvdr's infact NOT having the stated software loaded as stated in the auction combined with possible pirated software loaded etc etc is simply too much of a risk for TM to allow personally burnt cdr/dvdr's for sale on TM

However TM do allow linux variations to be sold on TM on a reguler basis but under what TM admin ruling I have no idea.

thats TM using their judgment on auctions, similar their allowance of 9.6ghz processors, except in this case it is a good idea
